APPROVAL OF AN AMENDMENT TO THE CERTIFICATE OF DESIGNATION
ISSUED TO THE GOODWIN SOLID WASTE DISPOSAL FACILITY TO ALLOW
TREATMENT OF PRODUCED WATERS FROM OIL AND GAS OPERATIONS.
WHEREAS, TC Operating LLC, requested an amendment to the existing Certificate of
Designation for a solid waste facility operated by Brent Gale of Goodwin Services to expand the
existing facility within the current permit area to include treatment of Oil and Gas Exploration
and Production Waste and disposal of the remaining brine in a saltwater injection well, and
WHEREAS, Robert Peterson, The Colorado Department of Public Health and Environment in a
letter dated May 10, 2012 recommended approval of the. amendment to the certificate of
WHEREAS, the Mesa County Planning Commission recommended approval to amend the
Conditional Use Permit at their October 28,2010, public bearing, and
WHEREAS, tbe Mesa County Board of County Commissioners in a public hearing on
November 16, 2010, approved an amendment to the Conditional Use to expand the existing
facility within the current permit area to include treatment of oil and gas exploration and
production waste and disposal of the remaining brine in a saltwater injection well.
NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF THE
COUNTY OF MESA FINDS AS FOLLOWS:
THAT public notice requirements of Section 3.1.8 of the Mesa County Land Development Code
(2000, as amended) have been met, and
THAT this request is in accordance with the health, safety and welfare of the residents of Mesa
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS IN THE COUNTY OF MESA, STATE OF COLORADO:
THAT the request to amend the Certificate of Designation for the Goodwin Solid Waste
Disposal Facility is approved with the following condition:
Goodwin Services shall comply with the conditions of approval listed in CDPHE's letter
dated May 10, 2012.
Conditions of approval of prior Mesa County Board of County Commissioners
resolutions shall still be applicable unless specifically amended in later BOCC
resolutions. Prior resolutions are, MCM 96-140, MCM 97-129, MCM 99-134, MCM
2004-034, MCM 2004-073 and MCM-2011-1 09.
